Banjo Biscuit ("Banjo Biscuit," "we," "us," or "our") is owned and operated by Studio 6453, LLC, a Florida limited liability company located at 1065 SW 8th St #2079, Miami, FL 33130. This Privacy Policy describes how we collect, use, share, and protect information from visitors to banjobiscuit.com (the "Site"), subscribers to the Banjo Biscuit newsletter, and entrants to the Banjo Biscuit Photo Awards (the "Contest").

By using the Site, subscribing to the newsletter, or entering the Contest, you agree to the practices described in this Privacy Policy.


1. INFORMATION WE COLLECT

A. Information You Provide Directly

  • Newsletter signup: email address, first name, state of residence, pet name, pet type
  • Contest entry: all newsletter signup information, plus last name, photograph, optional caption, and payment information (processed by our third-party payment processor; we do not store full credit card numbers)
  • Winner verification: legal name, date of birth, mailing address, government-issued ID, IRS Form W-9 information (including Social Security number or Taxpayer Identification Number)
  • Customer support and communications: any information you provide when contacting us
  • Survey or feedback responses: if you choose to participate

B. Information Collected Automatically

When you visit the Site, we automatically collect:

  • IP address and approximate location
  • Browser type and version, device type, operating system
  • Pages visited, time spent, referring URL
  • Cookie and similar tracking data (see Section 6)

C. Information from Third Parties

We may receive information from:

  • Meta (Facebook, Instagram) when you engage with our ads or click through to the Site
  • Our email service provider, payment processor, and analytics providers
  • Public sources, when verifying winners

2. HOW WE USE INFORMATION

We use the information we collect to:

  • Send the Banjo Biscuit newsletter and related communications
  • Administer the Contest, including entry processing, judging, winner verification, prize fulfillment, and tax reporting
  • Display submitted photographs in the newsletter, on the Site, on social media, and in marketing materials, consistent with the license granted in the Contest Official Rules
  • Provide customer support and respond to inquiries
  • Improve the Site, newsletter, and Contest experience
  • Send promotional offers from Banjo Biscuit, our affiliates, and our sponsors and advertisers
  • Conduct analytics and measure marketing performance
  • Detect, prevent, and address fraud, security, and technical issues
  • Comply with legal obligations, including IRS reporting for prize winners
  • Enforce our Terms of Service and Contest Official Rules

3. HOW WE SHARE INFORMATION

We share information in the following circumstances:

  • Service providers: We share information with vendors who perform services on our behalf, including email delivery (Beehiiv or similar), payment processing (Stripe or similar), photo storage and hosting, analytics providers, and contest administration tools. These providers are authorized to use your information only as necessary to provide services to us.
  • Sponsors and advertisers: Aggregated, non-identifying information is shared with sponsors and advertisers. We do not share individual subscriber emails or personal information with advertisers without your consent.
  • Marketing partners: With your consent, we may share information with carefully selected pet industry partners (pet insurance, food, supplements, products, services).
  • Winner publicity: Winner first name, last name, hometown, state, pet name, and submitted photograph are used in publicity, as described in the Contest Official Rules.
  • Tax reporting: Winner tax information (W-9 data) is reported to the IRS as required by law.
  • Legal compliance: We disclose information if required by law, subpoena, court order, or government request, or to protect the rights, property, or safety of Banjo Biscuit, our users, or others.
  • Business transfers: If we are involved in a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred as part of that transaction.

We do not sell personal information in exchange for monetary consideration.


4. PHOTO USE

By submitting a photograph in connection with the Contest, you grant Studio 6453, LLC the perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, transferable license described in Section 12 of the Contest Official Rules. This license permits us to use, reproduce, modify, publish, distribute, and display your submitted photograph across all Banjo Biscuit and Studio 6453 properties, including in marketing and editorial uses, indefinitely. This license is granted regardless of whether you win.


5. YOUR CHOICES AND RIGHTS

A. Email Preferences

You can unsubscribe from the Banjo Biscuit newsletter at any time by clicking the unsubscribe link in any email or by contacting contact@banjobiscuit.com. Unsubscribing from the newsletter does not withdraw any contest entry or photo license previously granted.

B. Access, Correction, and Deletion

You may request access to, correction of, or deletion of your personal information by emailing contact@banjobiscuit.com. We will respond within 30 days. Note that:

  • Photo licenses already granted under the Contest Official Rules are perpetual and irrevocable; deletion of your account does not terminate those licenses
  • We may retain information as required by law (e.g., tax records for prize winners)
  • We may retain information necessary to prevent fraud or enforce our Official Rules

C. State-Specific Rights (California, Colorado, Connecticut, Virginia, Utah, and Other States)

Depending on your state of residence, you may have additional rights, including:

  • The right to know what personal information we collect, use, and share
  • The right to request deletion of your personal information (subject to exceptions)
  • The right to correct inaccurate personal information
  • The right to opt out of "sale" or "sharing" of personal information for targeted advertising
  • The right to non-discrimination for exercising these rights

D. Do Not Track

Our Site does not currently respond to "Do Not Track" browser signals.


6. COOKIES AND TRACKING

We use cookies, pixels, and similar tracking technologies on the Site to:

  • Operate the Site
  • Remember your preferences
  • Measure newsletter and ad performance
  • Enable Meta Pixel, Google Analytics, and similar marketing measurement
  • Personalize content and advertising

You can control cookies through your browser settings. Disabling cookies may affect Site functionality.


7. THIRD-PARTY SERVICES

The Site may contain links to or be integrated with third-party services (including Meta, Stripe, Beehiiv, and others). This Privacy Policy does not apply to those third-party services. We encourage you to review their privacy policies.


8. CHILDREN'S PRIVACY

The Banjo Biscuit Site, newsletter, and Contest are intended for adults 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete that information promptly.


9. DATA SECURITY

We use commercially reasonable administrative, technical, and physical safeguards to protect your information. However, no system is perfectly secure. You acknowledge that you provide information to us at your own risk.


10. DATA RETENTION

We retain personal information for as long as necessary to:

  • Provide the newsletter and Contest services
  • Comply with legal obligations (including tax recordkeeping for prize winners, generally seven years)
  • Resolve disputes and enforce our agreements

Photographs submitted to the Contest may be retained indefinitely, consistent with the perpetual license granted in the Official Rules.


11. INTERNATIONAL USERS

The Site is operated from the United States. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, which may have different data protection laws than your country.


12. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated via the newsletter or a Site notice. Your continued use of the Site or newsletter after changes constitutes acceptance of the updated Privacy Policy.
